Terms of Service

1. Acceptance of terms

These Terms of Service (the "Terms") govern your use of the Lernis application ("Lernis", "the Service" or "the App"), provided by IPGS ENERGY SRL, with registered office at Via Ugo Ojetti 7, 20151 Milan (Italy), certified email (PEC) ipgsenergy@pec.it ("we", "our").

By using Lernis you confirm you have read, understood and agree to these Terms. If you do not agree with any part of them, please do not use the Service.

2. Description of the Service

Lernis is a time-management app based on the Pomodoro technique, usable directly in your web browser and — in the future — as a native app. It offers a calm digital space to focus on your work through timed sessions, breaks and personal stats.

All essential features of Lernis are, and will remain, free of charge. The Service is supported by advertising built into the experience; an optional contribution is available to remove it.

• Configurable Pomodoro timer (focus, short break, long break, cycles)
• Personal task management (tasks, sub-tasks, notes)
• Statistics, streaks, session diary
• Theme customisation (paper, dawn, dusk, night), ambient sounds and rituals

3. Accounts and registration

You can use Lernis's core features without registering (guest mode): your data stays stored locally on your device. To sync data across devices and access statistics you may create an account via Apple, Google or email.

You agree to provide accurate information when registering and keep it up to date. You are solely responsible for the confidentiality of your credentials and for any activity occurring under your account.

You must be at least 14 years old to create an account, in line with Italian law. If you are a minor, the consent of a parent or guardian is required.

4. Acceptable use

We ask you to use Lernis with care and following the rules below. You may not:

• Use the Service for illegal, fraudulent or harmful activities
• Attempt to compromise the security, integrity or performance of the Service
• Reverse-engineer, decompile or otherwise modify the App without authorisation, except to the extent mandatorily permitted by law
• Use the App to send harassing, offensive or deceptive content, or content that violates third-party rights
• Bypass authentication mechanisms or access other users' accounts
• Use bots, scrapers or automated systems to access the Service

5. Your content

The tasks, notes, diary entries and all data you enter into Lernis remain your sole property. You grant Lernis only the technical, non-exclusive and revocable right needed to store, sync and display them within the App.

We do not read, sell or analyse the content you create. We will not use it to train AI models or for any purpose other than running the Service.

6. Intellectual property

Lernis, its design, source code, trademarks, illustrations and App content are protected by copyright, trademark and other intellectual-property laws.

We grant you a personal, non-exclusive, non-transferable and revocable licence to use the App on your devices for personal, non-commercial purposes.

7. Free service and advertising

All essential features of Lernis are free. The Service is supported by advertising: personalised ads are shown only with your prior consent, as described in the Privacy Policy. An optional contribution is available to remove advertising. There are no mandatory subscriptions or essential features locked behind payment.

The optional contribution to remove advertising constitutes the supply of digital content. If you request its immediate activation, you consent to performance before the withdrawal period expires and acknowledge that you lose the right of withdrawal once performance is complete, pursuant to art. 59(1)(o) of the Italian Consumer Code (Legislative Decree 206/2005).

We reserve the right to change how the Service is supported in the future and to introduce optional paid features to fund development, while keeping access to essential features free.

8. Service changes and availability

We may update, improve or temporarily suspend the Service at any time, for example for technical maintenance or improvements. We will minimise disruptions where possible.

Significant changes to features will be communicated in advance via the App or by email.

9. Disclaimers

Lernis is provided "as is" and "as available". Although we work to provide a reliable service, we cannot guarantee it will always be free from interruptions, errors, data loss or vulnerabilities.

We recommend that you periodically back up data that is important to you.

10. Limitation of liability

To the maximum extent permitted by applicable law, Lernis will not be liable for indirect, incidental, special or consequential damages arising from the use of, or inability to use, the Service, including loss of profits, data or business opportunities.

Nothing in these Terms excludes or limits liability for wilful misconduct, gross negligence or any other liability that cannot be excluded under applicable law, including the mandatory rights granted to consumers.

11. Termination

You may delete your account at any time from the App settings. Deletion results in the permanent removal of your data within 30 days, unless we are legally required to retain it for longer.

We may suspend or terminate your access to the Service in case of serious or repeated breach of these Terms, with prior notice where reasonably possible.

12. Changes to the Terms

We may update these Terms from time to time. Material changes will be communicated by email or in-app at least 30 days in advance.

By continuing to use the Service after the changes take effect you accept the new Terms. If you disagree, you may delete your account.

13. Governing law and jurisdiction

These Terms are governed by Italian law.

Any dispute arising from the use of the Service will be subject to the exclusive jurisdiction of the courts of Milan, Italy. If you use the Service as a consumer, the mandatory jurisdiction of the court of your place of residence or elected domicile remains unaffected, under the Italian Consumer Code.
